Terms of Service
The Best Tapa is a community guide to the best tapas, built on photos and votes from real people at real venues. These terms set out the deal between you and us when you use the app. Read them, because using The Best Tapa means you accept them.

1. Who we are and what these terms cover
Buenvest operates The Best Tapa. When we say "we" or "us", we mean Buenvest. These terms apply to everyone who uses the app, whether you browse as a guest or sign in.
You can explore public discovery without an account. To submit a tapa, upload a photo, or vote, you need to sign in.
2. Your account
You need to be at least 16 to create an account. Keep your login details to yourself, and tell us at support@thebesttapa.com if you think someone else is using your account.
You are responsible for what happens under your account.
3. What The Best Tapa is
The Best Tapa is a guide that other people build. Users submit the tapas, take the photos, and cast the votes. We host that content, organize it, and rank it, and we run the moderation that keeps it trustworthy.
We do not write the reviews or create the content ourselves, and a listing on The Best Tapa is not our recommendation or endorsement of a venue.
4. Your content and the license you give us
You keep ownership of the photos, tapas, and anything else you post. By posting it, you give us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, display, translate, adapt, and create derivative works from your content so we can run, improve, and promote The Best Tapa.
We translate submissions between Spanish and English so more people can use the guide, and this license is what lets us do that. If you delete your account, this license continues for content that stays in the public guide, such as a published tapa other people have voted on. See section 8 for what happens to your contributions.
5. Rules for posting
When you post, you promise us that:
- You took the photo or have the right to share it.
- What you post reflects your own first-hand experience at the venue.
- The venue and dish details are accurate to the best of your knowledge.
- Your content is not fake, misleading, defamatory, infringing, or offensive.
Our Moderation Policy spells out the full rules for photos, venue accuracy, spam, and offensive content. Break these rules and we can remove the content or limit your account.
6. Votes and rankings
Rankings come from real votes by real users. Vote only when you are at the venue, since we check your location at the moment of the vote.
Do not manipulate the rankings. That means no fake or coordinated voting, no using several accounts to push a venue up, and no paying for placement. You cannot buy a better position, and we can adjust rankings or remove votes when we detect manipulation.
7. For venues
If your bar or restaurant appears on The Best Tapa, it is there because users posted tapas from it. We do not verify or endorse that content, and a listing does not mean we partner with you or recommend you.
Your position in the guide reflects user votes, and it is not for sale. If you spot content about your venue that is fake, abusive, or wrong, flag it through the Report option in the app or email support@thebesttapa.com with the details, and a moderator will review it.
8. Reporting and moderation
Anyone can report a tapa, photo, or listing, and a moderator reviews every report. We can publish, hide, edit, or remove content, and we can restrict or close accounts that break these terms.
When we remove your content or act on your account, we tell you the reason where the law asks us to. Our Moderation Policy explains how takedowns work.
9. The service comes as is
We offer The Best Tapa and its content as is. We do not verify or endorse the tapas, photos, votes, or rankings that users create, so use your own judgment when you rely on them.
We work to keep the app running well, but we do not promise it will always be available or free of errors.
10. Our liability
We are not liable for indirect or consequential loss, or for loss that flows from user content or from a venue or person acting on it. We limit our liability to the extent Spanish and EU law allows.
Nothing in these terms removes the rights you have as a consumer, or our liability for things the law does not let us exclude, such as fraud or harm we cause through serious fault.
11. Indemnity
If your content or your breach of these terms leads someone to bring a claim against us, you agree to cover the reasonable costs and damages we face from that claim, as far as the law allows.
12. Suspension and ending your account
You can delete your account at any time from your account screen. We can suspend or close an account that breaks these terms or the Moderation Policy, and we tell you why where the law requires it.
13. Governing law and disputes
Spanish law governs these terms. If something goes wrong, email us first at support@thebesttapa.com and we will try to sort it out.
You keep your consumer rights, including the right to bring a claim in the courts of the country where you live. We do not force you into arbitration, and we do not ask you to waive a class action.
14. Changes to these terms
We update this page when the service changes, and we move the date at the top when we do. If you keep using The Best Tapa after a change, you accept the updated terms.
